These Terms of Service ("Terms") govern your access to and use of deependtraining.com and any coaching programs, digital products, resources or services provided by Deep End Training.
Deep End Training is operated by Deep End Training Limited, a company incorporated in Hong Kong ("Deep End Training", "Deep End", "we", "us" or "our").
Website: deependtraining.com
Email: [email protected]
By purchasing, enrolling in, accessing or using a Deep End Training service, you ("Client", "you" or "your") agree to these Terms.
1. OUR SERVICES
Deep End Training provides online fitness, training, nutrition, lifestyle and accountability coaching.
Depending on the program purchased, services may include:
- Personalised training programming
- Nutrition guidance and targets
- Cardio and activity targets
- Progress tracking
- Client check-ins
- Coach feedback
- Coaching calls
- Messaging support
- Educational resources
- Community access
- Access to third-party coaching software
- Other services specified at the time of enrolment
The exact inclusions, duration and price of your program will be communicated to you before purchase.
Different programs may have different levels of coaching support.
2. ELIGIBILITY
Unless otherwise agreed by Deep End Training, our paid coaching services are intended for individuals aged 18 years or older.
By purchasing coaching, you confirm that:
You are at least 18 years old
The information you provide to us is accurate
You have the legal capacity to enter into this agreement
You are participating voluntarily
3. PROGRAM TERM
Deep End Training coaching programs are generally sold for a fixed program term rather than as cancel-anytime monthly memberships.
Your specific program duration will be communicated to you before purchase.
Programs may include, for example:
24-week / six-month coaching programs
16-week coaching programs
Shorter renewal or extension periods
Another period expressly agreed between you and Deep End Training
Your program begins on the agreed commencement date and continues for the applicable program term, subject to any approved pause or extension.
Payment Plans
Where you select an instalment payment option, the payment plan is a method of paying the agreed program fee.
A payment plan does not, by itself, convert a fixed-term coaching program into a week-to-week or month-to-month membership.
Unless otherwise expressly stated before purchase, enrolling in a fixed-term program means you are committing to the program and associated fees for that term, subject to the cancellation rights set out in these Terms and any rights you may have under applicable law.
4. FEES AND PAYMENTS
The price and payment schedule applicable to your program will be disclosed before you enrol.
Depending on the offer, payment may be made:
Upfront
By instalments
Through an agreed recurring payment schedule
By another payment method approved by Deep End Training
By selecting a recurring payment option, you authorise Deep End Training and its payment provider to charge the payment method you provide in accordance with the agreed payment schedule.
You are responsible for ensuring your payment information remains accurate and current.
Unless expressly stated otherwise, prices are charged in the currency displayed or agreed at enrolment.
Currency conversion charges, international transaction fees or other charges imposed by your bank or card provider are your responsibility.
5. FAILED OR OVERDUE PAYMENTS
If a scheduled payment fails, we may:
Attempt to process the payment again
Contact you to update your payment method
Temporarily suspend coaching services or platform access until the account is brought up to date
Take reasonable steps to recover legitimately outstanding amounts
A failed payment does not automatically cancel your coaching agreement or your payment obligations.
If you are experiencing genuine financial difficulty, contact us as soon as possible at [email protected] so we can discuss your circumstances.
6. CANCELLATION BY THE CLIENT
Because Deep End Training programs may involve fixed coaching periods, coach allocation, programming, onboarding, planning and reserved coaching capacity, enrolling in a fixed-term program is a commitment to that program.
If you wish to request cancellation before your agreed program end date, you must contact us in writing at:
We will confirm the status of your account, your program term and any applicable financial obligations.
Where permitted by applicable law, amounts already paid for coaching already supplied are generally non-refundable.
Where an early termination amount or remaining contractual amount applies, we will communicate that amount to you and apply the cancellation terms disclosed to you when you enrolled.
Deep End Training may, at its discretion, agree to alternative arrangements in exceptional circumstances.
Exceptional Circumstances
If you experience circumstances such as:
Serious illness or injury
Significant financial hardship
Bereavement
Another serious event materially affecting your ability to participate
Please contact us.
We may request reasonable supporting information and may, at our discretion, offer a pause, modified arrangement or early termination arrangement.
Nothing in this section limits any right or remedy you may have that cannot legally be excluded.
7. REFUNDS
Deep End Training does not generally provide refunds merely because a Client:
Changes their mind
No longer wishes to participate
Stops completing training or check-ins
Does not use the coaching services made available
Experiences a change in personal priorities
Fails to achieve a desired result
Decides the program is no longer suitable after commencement
Upfront payment does not create an automatic entitlement to a refund for unused portions of a fixed-term program.
Nothing in this section excludes or restricts any refund, remedy or other right that you are entitled to under applicable law and which cannot lawfully be excluded.
Where Deep End Training agrees to a discretionary refund, the amount and method of refund will be confirmed in writing.
8. PROGRAM PAUSES / HOLDS
For programs where a pause is offered, a Client may generally request one pause of up to four weeks during a six-month coaching term, unless different pause terms were specified when the Client enrolled.
Pauses:
Must be requested and approved by Deep End Training
Cannot generally be applied retrospectively
Temporarily suspend active coaching services for the approved period
Normally extend the program end date by the length of the approved pause
Payment treatment during a pause will depend on the payment arrangement applicable to your program and will be confirmed when the pause is approved.
Unused pause entitlement has no cash value and is not refundable.
Additional or extended pauses may be considered in exceptional circumstances at Deep End Training's discretion.
9. CLIENT RESPONSIBILITIES
To allow us to coach you effectively, you agree to:
Provide accurate and relevant information
Inform your coach of injuries, illnesses, medical conditions or material changes that may affect your ability to train
Communicate honestly regarding your training, nutrition and progress
Follow reasonable safety instructions
Use equipment appropriately
Complete agreed check-ins where possible
Treat coaches, staff and other community members respectfully
Keep your account credentials secure
Seek appropriate professional medical advice where necessary
You remain responsible for deciding whether you are physically capable of performing a particular exercise or activity.
10. HEALTH AND MEDICAL DISCLAIMER
Deep End Training provides fitness, exercise, nutrition, lifestyle and accountability coaching.
Our services are not medical services and are not intended to diagnose, treat, cure or prevent any disease, injury, medical condition or mental health condition.
Our coaches do not replace your doctor, physiotherapist, psychologist, dietitian or other appropriately qualified healthcare professional.
You should obtain appropriate medical advice before beginning or materially changing an exercise or nutrition program if you:
Have an existing medical condition
Have an injury
Take medication that may affect exercise or nutrition
Have been advised to restrict physical activity
Are pregnant or recently postpartum
Otherwise have concerns regarding your ability to safely participate
If you experience severe pain, dizziness, chest pain, difficulty breathing or another concerning symptom, stop exercising and seek appropriate medical attention.
11. NUTRITION INFORMATION
Nutrition coaching and resources provided by Deep End Training are intended for general fitness, body-composition and lifestyle purposes.
Unless expressly provided by an appropriately qualified professional acting within their professional scope, our nutrition coaching does not constitute medical nutrition therapy or treatment of a medical condition.
Clients with allergies, eating disorders, medical dietary requirements or other clinical nutrition concerns should consult an appropriately qualified healthcare professional.
12. RESULTS
Deep End Training does not guarantee that every Client will achieve a particular amount of weight loss, body composition, fitness level, strength level, running performance or other outcome.
Results vary between individuals and can be affected by factors including:
Adherence
Starting condition
Training history
Nutrition
Sleep
Lifestyle
Medical circumstances
Stress
Consistency
Other individual factors
Testimonials, transformations and previous Client results illustrate individual experiences and are not promises that every Client will achieve the same result.
If Deep End Training expressly offers a written results guarantee for a particular promotion or program, that guarantee will be subject to its separately stated eligibility and compliance requirements.
13. COACHING COMMUNICATION
We may communicate with Clients through platforms including:
Everfit
Telephone
SMS
Video conferencing
GoHighLevel or related communication systems
Other platforms reasonably required to deliver coaching
Response times may vary and coaching messaging does not constitute a 24-hour emergency service.
If you have a medical emergency, contact the appropriate emergency or healthcare service rather than relying on your Deep End Training coach.
14. THIRD-PARTY PLATFORMS
We may use third-party providers to deliver parts of our services, including coaching platforms, payment processors, messaging systems, CRM systems, video conferencing services and other technology providers.
Your use of those platforms may also be subject to the provider's own terms and privacy policies.
Deep End Training is not responsible for outages or interruptions outside our reasonable control, although we will take reasonable steps to maintain continuity of our coaching services.

Acceptance of these Terms does not automatically provide Deep End Training with blanket permission to publicly use identifiable progress photographs, testimonials or transformation content for advertising.
Where we wish to use identifiable Client content publicly for promotional purposes, we may request separate consent.

17. CONDUCT

Deep End Training may suspend or terminate services where a Client engages in serious or repeated:
Harassment
Threats
Abusive behaviour
Discriminatory behaviour
Fraudulent activity
Deliberate misuse of our systems
Unauthorised distribution of our intellectual property
Other material breaches of these Terms
Where services are terminated by us, any financial consequences will depend on the circumstances and applicable law.
18. CHARGEBACKS AND PAYMENT DISPUTES
If you believe a payment has been processed incorrectly, please contact [email protected] promptly so we can investigate.
Initiating a chargeback does not automatically cancel an otherwise valid contractual payment obligation.
Where a payment dispute or chargeback occurs, we may provide our payment processor or financial institution with relevant records reasonably necessary to respond to the dispute, including enrolment records, payment records, communications and evidence of services supplied.
We will handle personal information used for this purpose in accordance with our Privacy Policy and applicable law.
19. CONSUMER RIGHTS
Nothing in these Terms is intended to exclude, restrict or modify any statutory consumer right, guarantee or remedy that cannot lawfully be excluded, restricted or modified.
If any provision of these Terms conflicts with a mandatory consumer protection law applicable to you, that mandatory law will prevail to the extent of the conflict.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Deep End Training will not be liable for indirect, incidental, special or consequential loss arising from your use of our services.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
You acknowledge that exercise and physical activity inherently involve some risk and that you are responsible for exercising within your capabilities and seeking professional medical advice where appropriate.
21. PRIVACY
Your personal information will be handled in accordance with the Deep End Training Privacy Policy.
22. CHANGES TO SERVICES

We may update these Terms from time to time to reflect changes to our services, business operations or legal obligations.
Changes will apply prospectively from the effective date of the updated Terms unless applicable law permits otherwise.
Material changes affecting existing Clients will be communicated where reasonably appropriate.
24. GOVERNING LAW
These Terms are governed by the laws of the Hong Kong Special Administrative Region, subject to any mandatory consumer protection laws or rights that may apply to you and cannot lawfully be excluded.
Any dispute will be subject to the jurisdiction of the courts of Hong Kong, except to the extent applicable law provides otherwise.
25. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
26. ENTIRE AGREEMENT
These Terms, together with:
The program or offer details provided to you
Your agreed payment arrangement
The Refund & Cancellation Policy
Any additional written terms expressly agreed between you and Deep End Training
form the agreement governing your coaching service.
If specific written terms for a particular offer conflict with these general Terms, the specifically agreed terms will apply to that offer to the extent of the inconsistency.
